Agreement for Using Our Services

Note: Anjean is currently preparing for service launch. These terms will apply when the service launches.

These Terms of Service (hereinafter referred to as "Terms") set forth the terms and conditions for the use of the guide matching platform service (hereinafter referred to as "Service") provided by Anjean Inc. (hereinafter referred to as "Company") on this website. All registered users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.

Article 1 (Application)

  1. These Terms shall apply to all relationships between Users and the Company regarding the use of the Service.
  2. The Company may establish various rules and regulations (hereinafter referred to as "Individual Regulations") regarding the use of the Service in addition to these Terms. These Individual Regulations, regardless of their names, shall constitute part of these Terms.
  3. If the provisions of these Terms contradict the Individual Regulations, the Individual Regulations shall prevail unless otherwise specified.

Article 2 (Registration)

  1. Registration for the Service shall be completed when a prospective user agrees to these Terms, applies for registration using the method prescribed by the Company, and the Company approves such application.
  2. The Company may not approve a registration application if the Company determines that the applicant:
    • Has provided false information in the registration application
    • Has previously violated these Terms
    • Is otherwise deemed inappropriate by the Company

Article 3 (Management of User ID and Password)

  1. Users shall properly manage their User ID and password for the Service at their own responsibility.
  2. Users may not transfer, lend, or share their User ID and password with third parties under any circumstances.
  3. When a User ID and password combination matching the registration information is used to log in, the Company shall consider it as use by the User who registered that User ID.
  4. The Company shall not be liable for any damage caused by the use of a User ID and password by a third party, except in cases of intentional misconduct or gross negligence by the Company.

Article 4 (Usage Fees and Payment Methods)

  1. Users shall pay the usage fees separately determined by the Company and displayed on the website as consideration for the paid portions of the Service, using the method designated by the Company.
  2. If a User delays payment of usage fees, the User shall pay late payment damages at a rate of 14.6% per annum.
  3. Compensation to guides shall be paid by the method determined by the Company after deducting the commission determined by the Company.

Article 5 (Prohibited Activities)

Users shall not engage in the following activities when using the Service:

  • Activities that violate laws or public order and morals
  • Activities related to criminal acts
  • Activities that infringe on intellectual property rights including copyrights and trademarks contained in the Service
  • Activities that destroy or interfere with the server or network functions of the Company, other Users, or third parties
  • Commercial use of information obtained through the Service
  • Activities that may interfere with the operation of the Company's services
  • Unauthorized access or attempts thereof
  • Collection or accumulation of personal information about other Users
  • Use of the Service for fraudulent purposes
  • Activities that cause disadvantage, damage, or discomfort to other Users or third parties
  • Impersonation of other Users
  • Advertising, promotion, solicitation, or business activities on the Service without the Company's permission
  • Activities aimed at meeting strangers of the opposite sex
  • Activities that directly or indirectly provide benefits to anti-social forces
  • Other activities deemed inappropriate by the Company

Article 6 (Suspension of Service)

  1. The Company may suspend or interrupt all or part of the Service without prior notice to Users if:
    • Maintenance, inspection, or update of the computer system for the Service is performed
    • Provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outage, or natural disasters
    • Computers or communication lines are stopped due to accidents
    • The Company otherwise determines that provision of the Service is difficult
  2. The Company shall not be liable for any disadvantage or damage suffered by Users or third parties due to suspension or interruption of the Service.

Article 7 (Usage Restrictions and Registration Cancellation)

  1. The Company may restrict the use of all or part of the Service or cancel registration without prior notice if a User:
    • Violates any provision of these Terms
    • Is found to have false information in registration details
    • Defaults on payment obligations
    • Does not respond to communications from the Company for a certain period
    • Has not used the Service for a certain period
    • Is otherwise deemed inappropriate by the Company
  2. The Company shall not be liable for any damage caused to Users by actions taken by the Company under this article.

Article 8 (Withdrawal)

Users may withdraw from the Service through the withdrawal procedures prescribed by the Company.

Article 9 (Disclaimer of Warranties and Limitation of Liability)

  1. The Company does not warrant, either explicitly or implicitly, that the Service is free from factual or legal defects (including defects, errors, bugs, and rights infringements related to safety, reliability, accuracy, completeness, validity, fitness for specific purposes, and security).
  2. The Company shall not be liable for any damage caused to Users arising from the Service, except in cases of intentional misconduct or gross negligence by the Company.
  3. Even in cases where the preceding paragraph does not apply, the Company shall not be liable for damages arising from special circumstances (including cases where the Company or User foresaw or could have foreseen the occurrence of damage) among damages caused to Users by default or tort due to the Company's negligence (excluding gross negligence).
  4. The Company shall not be responsible for transactions, communications, or disputes between Users and other Users or third parties regarding the Service.
  5. The Company does not guarantee successful matching between guides and Users.

Article 10 (Changes to Service Content)

The Company may change, add, or discontinue the content of the Service with prior notice to Users, and Users shall accept this.

Article 11 (Changes to Terms of Service)

  1. The Company may change these Terms without individual consent from Users if:
    • The changes conform to the general interest of Users
    • The changes are reasonable in light of the purpose of the Service usage contract and the necessity for changes, the appropriateness of the changed content, and other circumstances related to the changes
  2. The Company shall notify Users in advance of changes to these Terms, the content of the changed Terms, and when they will take effect.

Article 12 (Handling of Personal Information)

The Company shall appropriately handle personal information obtained through the use of the Service in accordance with the Company's "Privacy Policy."

Article 13 (Notifications and Communications)

Notifications or communications between Users and the Company shall be made by methods determined by the Company. Unless the Company receives notification of changes in the prescribed manner, the Company shall consider the currently registered contact information as valid and send notifications or communications to such contact information, which shall be deemed to have reached Users at the time of transmission.

Article 14 (Prohibition of Assignment of Rights and Obligations)

Users may not assign their position under the usage contract or rights or obligations under these Terms to third parties or provide them as collateral without the prior written consent of the Company.

Article 15 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by Japanese law.
  2. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Company's head office.
